Introduction

We are committed to protecting your privacy and handling personal information in accordance with the Privacy Act 1988 (Cth), including the Australian Privacy Principles, where applicable.

This Privacy Policy explains the kinds of personal information we collect, how we collect it, how we use and disclose it, how we store it, and how you may access or correct it or make a privacy complaint.

This Privacy Policy applies to personal information collected through our App and any related website or services we provide.

By using the App or Services, you acknowledge that you have read this Privacy Policy. We may update this Privacy Policy from time to time. The latest version will be made available in the App and/or on any website we operate in connection with the App.

The kinds of personal information we may collect, and the reasons we collect it, include the following:

Account, identity and contact information

This may include your name, username, email address, phone number, login details, account preferences, subscription status, and any other information you provide when creating or managing an account or contacting us.

We collect this information to:

  1. create and administer your account;
  2. provide the App and Services to you;
  3. verify your identity and maintain account security;
  4. communicate with you about the App, Services, support issues, updates and service notices;
  5. manage subscriptions, billing support and account access; and
  6. comply with legal obligations and resolve disputes.

We may also use limited contact information to send service-related communications. We will only send direct marketing communications where permitted by law, and you may opt out at any time.

Location Data and Route Content

Because the App includes real-time tracking, route recording and playback, we may collect Location Data and Route Content when those features are enabled and used.

This may include:

  1. GPS or other location information from your device;
  2. route history, playback data, timestamps, distance, speed, and mapping overlays;
  3. metadata associated with recorded or created routes; and
  4. information about route exports, sharing and transfers.

We collect this information to:

  1. provide the core functionality of the App, including tracking, route recording and playback;
  2. enable route storage, export and sharing features you choose to use;
  3. improve the performance and functionality of the App;
  4. generate aggregated and/or de-identified analytics; and
  5. maintain security, investigate misuse, and comply with legal obligations.

Where required by law, you are responsible for ensuring that any person being tracked has the knowledge of, and has given any consent required for, such tracking.

If you choose to export, share, transfer or sell Route Content to third parties, you are responsible for that decision and for ensuring that such sharing or transfer does not unlawfully disclose another person's personal information or location information.

Analytics and usage information

We may collect information about how you use the App and Services, including:

  1. device type, operating system, app version and identifiers;
  2. log data, crash data, session data and performance information;
  3. how and when features are used;
  4. route-related usage patterns; and
  5. information about your interaction with our App, website or support channels.

We use this information to:

  1. operate, maintain and improve the App and Services;
  2. diagnose technical issues and improve performance;
  3. understand feature usage and user behaviour; and
  4. generate analytics.

Where analytics are commercialised or disclosed externally, they will be provided in aggregated and/or de-identified form and are not intended to identify individual users. Where we disclose aggregated and/or de-identified analytics externally, we do so on the basis that those outputs are not intended to identify any individual user.

App, device and technical usage information

We may automatically collect technical and usage information from your device and your use of the App and Services. This may include IP address, device identifiers, device type, operating system, app version, language settings, crash reports, timestamps, and diagnostic data.

We use this information to:

  1. operate and secure the App and Services;
  2. troubleshoot issues and improve performance;
  3. understand usage trends and feature effectiveness; and
  4. support de-identified analytics and business reporting.

How we collect personal information

We may collect personal information:

  1. directly from you when you create an account, subscribe, contact us, request support, or use the App;
  2. automatically from your device and use of the App and Services;
  3. from Platform Providers and payment processors in relation to subscription status and transactions;
  4. from third-party service providers that help us operate the App and Services; and
  5. from other people where you share Route Content or route-related information with them through the App.

Where reasonable and practicable, we will collect personal information directly from you.

How we use and disclose personal information

We may use and disclose personal information for purposes including:

  1. providing and administering the App and Services;
  2. managing accounts, subscriptions and support requests;
  3. enabling route recording, playback, export and sharing features;
  4. maintaining security, preventing misuse and enforcing our terms;
  5. communicating with you about operational matters, updates and support;
  6. complying with legal obligations and responding to lawful requests;
  7. improving the App and Services; and
  8. generating aggregated and/or de-identified analytics.

We may disclose personal information to service providers who assist us with app hosting, storage, infrastructure, support, analytics, diagnostics, communications, subscription administration, payment support and related operations.

We may also disclose personal information where required or authorised by law, including to courts, regulators, law enforcement agencies and government authorities.

We do not sell identifiable personal information to third parties. If analytics are shared or commercialised externally, they will be in aggregated and/or de-identified form.

Why collection is necessary and what happens if you do not provide information

Some personal information is necessary for us to create and manage your account, provide the App and Services, process subscriptions, enable tracking and route features, maintain security and respond to support requests.

If you do not provide requested information, or if you disable permissions such as location permissions, some parts of the App or Services may not function properly or at all.

Direct marketing

We may send you direct marketing communications about our own products or services where permitted by law.

You may opt out of receiving marketing communications at any time by using the unsubscribe function in the communication or by contacting us using the details below.

We will not use or disclose your personal information for direct marketing in a way that is inconsistent with the Privacy Act 1988 (Cth).

Subscription and payment information

Subscriptions are paid and managed through the relevant Platform Provider (for example Apple App Store or Google Play) or another payment method we make available.

We do not receive or store your full payment card details where payment is processed by a Platform Provider or third-party payment processor. We may receive limited transaction information, such as confirmation of payment, subscription status, renewal status, transaction identifiers, billing period and related account information, to enable us to provide the Services, administer subscriptions, and deal with support or billing issues.

Payment information is handled by the relevant Platform Provider or payment processor under their own terms and privacy practices.

Storage, security and retention

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

We may store personal information electronically using third-party service providers and cloud systems.

We retain personal information only for as long as reasonably necessary for the purposes set out in this Privacy Policy, to provide the App and Services, to resolve disputes, enforce our agreements, comply with legal obligations, and maintain appropriate business records.

When personal information is no longer reasonably required, we will take reasonable steps to destroy it or de-identify it, subject to any legal or operational retention requirements.

Information we receive from third parties

We may receive personal information or related data from third parties such as Platform Providers, payment processors, analytics providers, hosting providers, mapping providers, diagnostics providers and support service providers, where this is necessary to operate the App and Services.

This may include subscription status, transaction confirmations, usage metrics, technical diagnostics, support-related information and similar operational data.

Cookies, SDKs and similar technologies

If we operate a related website, that website may use cookies and similar technologies to support functionality, remember preferences, improve performance, analyse traffic and help us understand how the website is used.

The App may also use software development kits (SDKs), device identifiers, log files and similar technologies to support authentication, functionality, diagnostics, analytics and security.

You can usually control cookies through your browser settings and some device permissions through your device operating system settings. However, disabling certain technologies may affect the operation of the App, website or Services.

Support enquiries and correspondence

When you contact us for support or send us a message, we may collect the information you provide to us, including your name, contact details, account details, device or subscription information, and the contents of your enquiry. We use this information to respond to your enquiry, provide support, investigate issues, improve the App and Services, and maintain appropriate business records. We may keep records of support enquiries and our responses for operational, legal and compliance purposes.

Complaints and related records

If you make a complaint to us, we may collect and keep the information you provide in order to investigate and respond to the complaint, communicate with you about it, and improve our services and complaint-handling processes. Where reasonably necessary to investigate or resolve the complaint, we may disclose relevant information to third parties such as service providers, advisers or regulators. We may also keep de-identified statistical information about complaints for internal reporting and service improvement purposes.

Access to and correction of personal information

You may request access to personal information we hold about you, and you may ask us to correct personal information that is inaccurate, out-of-date, incomplete, irrelevant or misleading.

To make such a request, please contact us using the details set out below. We may need to verify your identity before providing access or making corrections.

We will respond in accordance with applicable privacy law.

Overseas storage and disclosure

Some of our service providers may store or process personal information outside Australia, including through cloud hosting, infrastructure, support, diagnostics, analytics or platform services.

As a result, personal information may be disclosed to recipients located overseas. We take reasonable steps to ensure that overseas recipients handle personal information in a manner consistent with applicable privacy law and appropriate confidentiality and security obligations.

By using the App and Services, you acknowledge that overseas storage or processing may occur.

Disclosure to Government and their agencies

We are subject to the law like everyone else. We may be required to give information to legal authorities if they so request or if they have the proper authorisation such as a search warrant or court order.

Compliance with applicable law

This Privacy Policy is intended to reflect our privacy practices in relation to the App and Services and to comply with applicable Australian privacy law. If you access the App or Services from outside Australia, you do so at your own risk and are responsible for compliance with any local laws that apply to you.
